cool ill try and take it all apart again, i took the full thing off and unplugged it and pressed the button and it never even flickered any ideas or does it need to be earthed on the body?

that is the problem.. it is earthing on the body or somewhere else.. the wire is live and switch works backwards.. ie handbrake up switch on.. handbrake off switch off..

so you've completed the circuit somewhere else.. i.e. broken wire touching metal somewhere.

    brake fluid?

this could be the problem mate, check to make sure that your brake fluid is full.i know it sounds silly and you have probably checked it, but having low fluid will also put your light on
