Was it a case of a night allowance meaning you should get paid 150% of your wages, but instead of that you got 150% added rather than mulitplied, ie so you ended up with 250% instead of 150% or something like that?

If so, can easily see how if your boss agreed it was correct you would assume that you just were in a lucky position with how much extra you got, relatively easy mistake to make in those sort of circumstances.

easy mistake to make on both parties and gutting when its you that lands with a bill.

Its one of those things though, you've kind of had a massive bonus all along but it doesnt feel like that because youve only found out about it when it becomes a bad thing.

To be honest, bad as it is, only having to pay half back is a ****ing bargain that if I were in your boots I'd be ripping their arm of for. You wont get out of paying it back if its in your terms so you just have to alter your thinking.

You will still be 'up' £3k on where you should have been at the end of this

More to the point, who are you working for and are they hiring?! I work longer hours than that as a chef and don't earn anywhere NEAR that sort of money (even WITH the mistake taken out of the equation).

Re: being over paid, where do i stand??

Tell your boss that you thought you were getting more money because of an automatic index linked pay rise, and hence you didn't question him as to why you were getting paid more than you bargained for, it is an act of dishonesty by not questioning as to why you were getting paid more than you thought you deserved.

Now you will have to unfortunately pay it back, (50% as agreed by your boss) you should consider yourself lucky as many employers can constitute this as a deliberate attempt to steal by not reporting to them that you had been getting more wages than expected. I heard many employees have lost their jobs over similar issues, one employee lost his job as he failed to notify that his bank account had been debited with a large amount of money by his company in error and he eneded up spending it up! He clearly knew the money wasn't his and it was put into his account in error and he failed to notify them.

Sorry if this sounds harsh, but it can be constituted as stealing by your employer if he wants to.

Re: being over paid, where do i stand??

Turbostevo no bloody chance that was bought and paid for before I even started working at my current job

MSG, I no what your saying but I was NOT dishonest as I had told my boss what I was getting paid and he said "not bad like" so if that's being dishonest then shoot me

It's not harsh MSG it's the truth what you have said and it's not like I was hiding my earnings as I told my boss as did the other two guys so really I have done nothing wrong, only collected each month what I believed to have been a correct wage

Similar happened to me when I was in the army, got paid roughly 1850 more than I should of done. There was a few of us that it happened to. We had to pay it back over 12 months so hardly noticed it.
You'll be in trouble next year when you get your tax code through and it's like 88L! I've seen that a few times! I'd personally keep a written log of everything as far back as you can account for just so you've got some ammo to throw at the tax office. It seriously ****s things up mate and I feel for you!

yeah they have been fair in the sense that they are sweeping 50% under the carpet, and yeah it will be re-paid in my terms also as it was there mistake regardless of how its paid its still like im being bent over, and i find it ****ing anoying people saying what you moaning for youve been given free money, i am working night shift 12 hours a shift and its not like im sitting doing an office job its pretty physical at times but thats what were getting paid for, so no it wasnt free money as no one handed me over 6k and said spend that and we will get it off you later, they offerd to knock 50% off as it was there mistake

thats bloody good to know chap i would never in a million years have thought about next years tax code, the pay in question on the face of it i was earning not much under 40k a year in my hand (no point putting exact figure in) but thats close enough, granted it wasnt for a year but it just puts it into perspective of what a **** up some 1 has made

cheers for your input chap greatly appreciated

and you didnt post saying "what you moaning for" some people

Quite honestly, if a company had been over-paying me my wages for a considerable time, without my realising, I would consider it to be their ****-up, it is hard enough to work out tax and NI and other deductions and one is never in a clear picture with some pay roll slips, so I can't blame you for it, if you felt that you were misled by your wage slips, you should protest at a sudden demand for clawing back overpayment, and ask for it to be waived if possible as you have no savings or very little, they might cancel it altogether or arrange smaller deductions to recover from your normal pay.

Looking at your contract and knowing your payrates from day 1 would have prevented all this, but then again you wouldn't be a few grand up, so it pays to play dumb sometimes I suppose

Edit/ See MSG hasn't changed lmao

What's the problem. Surely getting overpaid for those months just meant you were able to increase the amount you were saving/investing each month. Therefore just withdraw the cash from savings/sell investments, and pay them back the 50%. You're still on top!

Shouldn't effect your lifestyle at all.
