    More lodger questions

    Sorry more stuff coming up and you lot seem to have a lot of experience with it!!

    The ex is asking where he will stand with regard to still owning half the house (Obv not been able to take on full mortage yet what with loosing job etc but will be doing as soon as physically possible)

    Basically he wants to pay less because I will have rented a room.

    Whats the lagal on this? My thought is that it's between me and the lodger and nothing changes with the ex as he is legally tied to paying half until such time as I can take on the full loan and write him out?

    It's between you and the lodger, you are paying the utilities .....

    Your ex is liable for agreements between himself and the mortgage provider .... nothing more.

    If I were you I would not have spoken to my ex about the lodger, if he found out there was another person I would then say he/she is just a friend staying with me for a few weeks!

    I'd seriously check that out with a solicitor first. As one of the legal owners of the property it's quite likely he's got some say in how the property is used or how the proceeds of any rental would be distributed. The legal position probably differs depending on if you bought as joint tenants or tenants in common as well.

    It's way over my head, but things like this get murky and it wouldn't take a particularly good solicitor to find something you'd owe him out of it should he decide he's being hard done to financially.

    Yer understand this - he's not a complete twot tho lol - nearly but not quite. There are some other factors too that I won't go into that mean I am basically doing him a serious favour by not being sh1tty and agreeing I will take on the house eventually etc etc as he could end up very seriously out of pocket/with some tasty debt.

    Will have a chat with solicitor buddy just to make sure tho

    My thoughts:

    If the property is jointly owned I would have thought that any party with an interest in the property (ownership) might have a right to a percentage of any monies raised by the use of said property. Unless of course you have agreed something diferent between you.

    Also I can kind of see his point - if you and him were to pay half of the morgage each but you were paying less by way of using the property for income I think I might feel a little hard done by too. After all take it to it's extreme - if your lodger was daft and paid you enough rent to cover the whole cost of the morgage, yet you continued to get money from your ex for his 'half' you could stick that in your pocket as profit. Or would you not want money from your ex in that scenario?

    Of course mayeb there shoudl be soem offset as it is you who is sharing with teh lodger and having teh onconvieniance. Saying that.... it is your ex is potentially paying a morgage for soemwhere which he has no benefit from and may never do (you might not give him any profit made when the house eventually sells???).


    Would be inetrested in hearing the official legal thoughts though.

    He has waived any rights to any profit - which there wouldn't be if sold now.

    Contact someone who works in the leagl profession and specialises in this sort of thing.

    A mate of mine got stung for about £70k as his 'partner' was paying 'rent' which was half of the mortgage. The mortgage was in his name. She was therefore legally entitled to half of the properties increase in value. I **** you not.

    Rightyho - tame solicitor says check deeds to see if any caveat written that spacificlly mentions dosh from odger - but if not then is just between me and lodger

    Also says is wise to draw up a quick agreement about paying what when etc to cover self

    First bit is right ... as I said earlier ...

    2nd bit, lodgers have no rights ..... you can chuck em out without notice and there is nothing they can do
    So don't complicate things by making agreements they can hold you to later or use as for proof of anything ...
