Advice Please re. Buying a car

I am buying a Cav Gsi, was hoping to pick it up yesterday, but lad won't let me have it until he gets plates changed - he has a private no. plate.

He went to DVLA in B'ham on Thursday to put his p/plate on retention, and hopefully get the new one straight away, however they are v.busy and had to send off to Swansea, so he has to wait for new V5 in post with new reg no. on it. He wont sell me the car without having this.

Now I have said that I don't mind picking up V5 when he gets it, as long as he puts details on receipt etc, I have no worries as I checked original V5, vin plates etc

He is reluctant - not sure why, but his mates have advised him not to let it go until he gets V5 - I would've thought i'm the one to worry, not him - but like I said i'm not bothered.

Is he right not to sell it till he has the V5, or not, or how can I put his mind at rest?

Edit - his p/plate is on retention now - so I couldn't have that anyway.

Well he is required by law to fill in and send off the V5 when he sells the car to you if you take the car and do something illegal in it he will have no proof he was not still the owner of the car, so hes right not to sell it till hes sent off the V5 wi your details on it.

I see - that makes sense - I didn't know that was the case.

A bit irritating, but suppose i'll have to wait.

Although surely a receipt, signed by both parties might have some bearing - no?

Not in the eyes of the law, just think about anyone you've sold a car to would you trust them not to do anything stupid when the car is not in your name, or mabye they have an accident and just feck off after it.........legally the owner is still to blame unless the V5 with the new owners details has been sent off.

DVLA in Birmingham would give him a new NUMBER IMMEDIATELY

so cant see why he cant give you the car and you can fill in a new form at the post office to change owner name into your's

by the way it will take about 2 weeks to get a new V5 from Swansea sent to him ... so you've got a long wait

He expected to get new no. immediately, however they are v.busy so cannot do immediately. They told him 7 days, but he's hopeful to have it Monday, as someone he knows did same recently and it took 3 days.

thats bull ... if they gave him a retention for his old one they HAVE to give him a new number for the car as the system wont allow a retention to be done until the car it comes off is given a new number or is put through as being scrapped

my mate just transferred his on thursday and got his new number straight away .. but will have to wait 2 to 3 weeks for the new V5's to come through
