No, hang on, no tax without MOT and insurance.

I've completely confused myself. Ignore me, I'm an idiot.

No MOT is not necessary to get insurance, but having an insurance for a car with failed or no Mot invalidates insurance in case of a claim. Because a car is considered unroadworthy without a valid MOT certificate even if the car is pysically OK, the rule applies to all cars over 3 yeras old.

Any way I didn't notice earlier yes but my car comes up with details such as 16V Eccotec. So I can't put a red top and not notify the insurance and the DVLC.

Sorry about the long post but I need to clear some things up.

You can be in possession of a certificate of insurance but not be insured. The most common scam is to pay the first couple of instalments, get the cet and then canx the policy. happens all the time. There are loads of insurance docs that are not valid out there.

The other thing that can happen is you fail a direct debit (dd) payment to the ins company. They canx the policy and you are unaware. They continue taking money through the dd arrangement as you have not canx it. The police then stop you, you think you are insured, but a quick call to the ins company reveals the policy was in fact canx.

As for seizures under S165 of the RTA.

The officer has to believe that there is no insurance - not suspect, but BELIEVE.

Let me run through some scenarios.

    1) Pull someone at 3pm showing no ins on the MID.
They tell you that they just bought the vehicle. The vehicle is registered to someone else on the PNC.
Check with their insurer 'Yes they are insured as of 2pm today'

Happy days, thanks very much, be on your way.

    2) Pull someone at 6pm showing no ins on the MID.
They tell you they have just bought the vehicle. The vehicle is showing registered for them for the last 6 months, and the tax is also expired. They have no insurance policy with them as 'it must be in the post'
They cant remember the insurer, and they cant remember how they insured this vehicle.
    But its 'definately' insured, boss.

Yeah right, have this form and collect your car when you have insured it.

    3) Pull someone at 8pm showing no ins on the MID.
They tell you that they have had the vehicle for 4 months and insured it with Norwich Union. 'Here is my policy, officer' Policy shows it being insured from 4 months ago.

I know that any company trading in insurance (private) in the UK must update the MID within 24 hours. It will filter to the police and eventually onto my system a couple of days after its been insured.
I know that NU is a UK company.
I do not believe their vehicle to be insured, I believe the policy to be canx. I seize the policy, seize the car.

Contact NU in the morning. 'Yes they had a failed dd and we cancelled the policy, we sent them a letter of cancellation on....'

We dont just seize a vehicle because its showing no insurance on the MID, we have done this job for a while, we know when people are lying, and we know how the system works. Only traffic officers can seize your vehicle to prevent any overreaction by people who dont know how it all works.

I have seized about 4 vehicles a day on average for the last 7 months. Not one has come back as being insured.

However, if a vehicle is insured and you have to pay the recovery fee, you can actually claim back this money from the police.
If it is the falt of your insurer, like they failed to update the MID as they are required to by law, you can claim back from them.

After all, if you are insured, you cannot be penalised for a **** up by your insurer.

Thats the ticket!, And is that 100% from the horses mouth?!

If so thats class, i'm not too sure about the 24hour thing though, when the system was first conceived it was agreed that a 72hr uppdate was feasible.

I remember a couple of years ago, my Insurance Agent sent me a letter stating clearly that due to new EU rules that I must send them a renewal payment well before the old policy comes to an end, failing that will reneder my policy cancelled and I will then have to re-establish a new policy all over as if I am a new customer, therefore filling in the forms all over and though this would not effect one's NCB, but it means you will be filling a form all over .

It is no longer possible to get cover over the phone unless pysical payment has been made first, this could be with a credit or debit cards and if paying by a cheqe it will have to be cleared first.

Not insurance related but how long usually does the DVLA website take to update to show taxed status?

Taxed the car on friday and it still shows as SORN.

Are you covered if your insurance allows you to drive someone's car with their -permission although that person who authorises you to drive his car himself hasn't insured his vehiocle?

As far as i'm aware your insured in whatever car you drive if it's part of your insurance although it's usually on 3rd party. So shouldn't matter if his car is insured or not but you will prob get a pull if the cops spot ya so better off keeping your insurance docs on you.
