    speeding fine

    Just recieved a speedin offence letter, sayin its the second letter they have sent when it is only the first. Also on the date stated im sure it was at the garage being worked on. I rang them up asking for photo evidence etc, they say that they cannot make out the driver only the car and plate etc due to glare from headlights as it was at night. Only problem being i have no proof that it was at the garage as the guy has shut up shop and done a runner since then. Any ideas?

    the offence is for a 51 in a 30 on a road i got down every day of the week so id be wary about doin that kind of speed some im 99% sure it wasnt me. Ideally id not like to have to go through courts etc etc as i dont have the time from work to do that kind of stuff, i just thought if it wud be clean cut that they could not prove it was me and i have my mate whose car was also at this garage to say otherwise aswell. No reciepts as the guy was an ass and just disappeared.

    as you say they "cant" prove it was you driving...and as for the plate ????
    tell them to f.u.k off..... they've got nothing on you...

    I think i will just send a letter and their letter back sayin it was the guy at the garage driving and see where it goes from there. I just didnt want them to bump up the fine and points etc

    I thought with speeding that the registered keeper got the points and fine if the driver of the vehicle is not established?!??!

    How did you pay? If you paid by plastic that would prove it.

    Correct

    They obviously cant identify the driver so the reg owner has to pay up and take the points

    thats bull**** they cant give u points for something u didnt do

    they could perhaps fine you for not knowing who the driver was but they cant give u points unless they can prove it was your driving it

    Im with aragon on this. How can they fine the owner because there camera cant make out the driver? He cant help if the guy at the garage is speedin. That means the guy at the garage can just deny drivin and the owner takes the points/fine?? That not law thats guess work on the cops account!

    Business: As a responsible employer you have a duty to identify the driver of the vehicle in question. If you are a company car owner your records should assist you to pinpoint the driver. Failure to nominate a driver could result in your company being taken to court.
    Private: As the registered owner of the vehicle you are required to provide the full name and address of the driver at the time of the alleged offence.

    I wasn`t the driver, what happens now?

    As the registered owner/keeper of the car you are required by law to provide the full name, address and date of birth of the driver at the time of the alleged offence.

    Failure to do so will result in proceedings against you for failing to supply the information as required under section 172 of the Road Traffic Act 1988.

    It is also your responsibility to prove that a valid certificate of insurance covered the driver of the vehicle at the time of the offence being discovered.

    They can and they do.

    Its the owners responsibility to know who is driving at a given time.

    That was a loophole used to get out of the offemce which was closed last year and resulting in the owner of the vehicle recieving the fine/points.

    Its not fair if you're honestly not driving but it stops those who did used to try and wriggle out of it.

    well according to whatuve just said u can be fined but they cant give u the points for speeding as it wasnt you...

    Yep, that's correct, you may have to go to court, and you'll more than likely end up with a fine, but this happens all the time, i was in the same boat, when a local garage repaired my car, they denied it of course, and they even
    changed the date on the receipt to a day later!, which i didn't notice at the time, when ever you take your car to a garage ALWAYS make sure you get a receipt to prove it was with them for however long!, cos if it's a quick car they'll always give it a good 'roadtest'!!!!!!

    The panalty for failing to supply is the same as the alleged offence. In the case of speeding, 3 to 6 points and a fine of upto £1000.

    Fill in the form saying at the time of the alleged offence the car was in for repair at the garage. If the garage has now closed down then there is nothing they can do. The law only says that are required to take reasonable steps to ensure you know who drives your car. You entrusted it to the garage and that is as far as you reasonably can go.

    If they ask for proof it was at the garage then you are NOT obliged to provide this, you will have fullfilled you obligations by telling them it was in the garage.

    Also, for reference, the photographs are there to link the vehicle to the offence and are not to be used to identify the driver of the vehicle.
